Denial is a wonderful drug and you are addicted. Race, religion, sexual orientation, they are ALL hate crimes. This is a classic example of a gay hate crime.

i agreee 99% just not that there fighting somethin internal.. that doesnt mean u fight someone else.. i hate people like this.. why cant they put themselves in others shoes.. yeahh it tuff having a different likes on the sam gender but who cares were all humans living the life we got.. i havent heard of a gay beat a straight person just becuase there straight… people reallly have to look at things twice.. its either beat someone up and be in jail of the rest of your life..

One would rather assert that you are jackass. You did not follow anything in this discourse but rather attempted to be a smartass and pick out bits and pieces then make a foolish comment.
It is clear that this instance is not a race related crime. Your issue lies with StoogeWatcher who initiated the course of dialogue along racial lines. I merely pointed out the definition of a racially motivated crime.
Please make an effort to follow as this is not quantum physics…

He is not going to get additional time SIMPLY for saying, “I hate you.” The burden of proof (which rests on the prosecutors going after the robber in your little scenario) that must be met is that the crime was commited BECAUSE the clerk was gay.

The hate crimes statutes are designed specifically for people who commit violent crimes on other people BECAUSE of their sexual orientation, gender, ethnicity, etc.

If I understand what you’re trying to say in this charming little comment (it’s difficult to dissect, with the grammar & spelling errors), allow me to respond.
1. There are TWO attackers beating the shit out of one defenseless person. This isn’t about gender; it’s about humanity. This person was outnumbered and beaten mercilessly.
2. Get smart and act tough like a female? What the fuck does that mean? I’m a female (and gay, too) but I have no idea what you’re insinuating with that.

Illustrating random cases proves nothing as they are not THIS particular case. Different people have different reasons and you’re trying to generalize ALL crimes.
Citing cases is a worthless game that can go on forever and proves nothing. Only this case is relevent here.

Perhaps you do not know what racially motivated crimes are. They are incidents such as when Troy D. West beat a 35 year old black woman and called her derogatory names. They are when an interracial couple gets harassed and shot by a neo-nazi skinhead who took offense to a black man dating a white woman.
Here is a hint: when race is the reason someone gets attacked/killed, that is called a racially motivated crime…

Do you mean the Jena6 Thugs that attacked a kid that said they should be hung for being black?
My assertion still holds true that incidents involving Caucasian victims and African American perpetrators ARE NOT racially motivated…
At least make the effort to illustrate cases that support your misguided accusations and not your adverary’s…

No, it isn’t. Federal courts have always been used to advance justice in civil rights cases and this bill is just an extension of that. You may be too young to remember the juries acquitting lynch mobs in the South and the use of federal courts and statutes on civil rights to change public perceptions of racism.

I’m WELL aware of enhanced punishment.
The bill says that if a state fails to get a conviction, eg; acquittal or dismissal, IT can pick up and try the case in it’s OWN court, overstepping state jurisdiction and sovereignty, to pursue it .
THAT dear, IS Double Jeopardy.
That is being prosecuted TWICE !!
